Terms and Conditons of Service

vpsOne ("vpsOne") will provide electronic services required for virtual private servers to an individual or business ("Client").

These terms of service will take effect when the client joins the hosting service of vpsOne. Henceforth, "we", "us" and "our" means vpsOne, the provider of this service, and "you" means the client.

By submitting your order, or by hosting and uploading any data to our servers, you acknowledge that you have thoroughly read, and agreed to abide with this Terms of Service.

We have the right to deny service to any client, for any reason whatsoever, that is deemed to be unsuitable for our servers. We also reserve the right to modify this Terms of Service without any notice whatsoever at our decision.

1. Content and Server Use
The content of the hosted site is the responsibility of the site owner alone, and not the responsibility of vpsOne. We have a zero-tolerance policy towards adult content, whether legal or not, any pornography, nudity or any obscene depictions whether in text or in pictures or photographs that may violate laws. We also do not allow any illegal "Warez" (pirated software), illegally ripped "MP3s", or anything else that is copyrighted, unless express permission is given from the owner of the document. Links or content that provides information about any illegal activity is unacceptable and not allowed. Any content that is abusive, threatening, profane and vulgar are not allowed on the network. Hate and racism are strictly prohibited. Viruses, data corrupted by viruses, and Trojan Horses are also prohibited to be stored on our servers. Anything IRC related is strictly not allowed, including, but not limited to, web clients, or bots. Additionally, we do not permit the operation of proxies or BitTorrent trackers on our network.

Inappropriate uses of email are also strictly prohibited. Examples of inappropriate usage includes, but is not limited to, spamming of any sort, UCE (Unsolicited Commercial Email), UBE (Unsolicited Bulk Email), passive spamming or "spamvertising" (promoting a site hosted with vpsOne by spamming from another server). Violations of our inappropriate email use policy may result in suspension or deletion of your account, and up to a $300 administration fee may be charged in severe instances. vpsOne reserves the rights to determine whether the emails sent are appropriate or inappropriate.

vpsOne retains the right to investigate any part of your account if approached by law enforcement, authorities or if we receive multiple reports of illegal or inappropriate activity originating from your account. If asked by law enforcement, vpsOne will provide the authorities with access to your account.

If any part of the TOS is broken, vpsOne reserves the rights to delete, nullify and refuse the member's account.

2. Indemnification
You must agree to provide clear, accurate, and complete information about you as required by vpsOne when signing up, and must keep it current at all times. You agree to use all services and facilities provided by vpsOne at their own risk. In no event shall vpsOne be liable for any loss, loss of data, or any commercial damage, including but not limited to special, consequential, incidental, or any other damages. You agree to hold vpsOne harmless from any losses, costs, penalties, fines, demands, or liabilities, including legal and attorney fees that may have resulted from any service provided or will provide to you.

3. Payment Policies
All accounts are setup on a prepaid basis. Full payment is required before any hosting services are issued. We reserve the right to modify the price at any time.

Prepayment is due every 30 days from the date that the account was first created, or every 365 days if the account is paid yearly. Billing will continue unless a cancellation request is received 5 days before your next billing date. You will automatically be charged every 30 days if paying monthly, or every 365 days if paying yearly. This will continue unless you cancel the account, and vpsOne has authorised the request.

You also agree to pay any extra charges that their accounts may incur, including but not limited to extra bandwidth usage, and extra disc space usage. All monetary transactions are in US Dollars.

Accounts not paid by the due date are subject to a late fee of $15.00. Service interruption will occur on accounts that are 5 days past due. Service interrupted for non-payment will remain deactivated until the account balance is paid in full. Accounts that are 15 days past due will be terminated and all data and backups deleted from our systems.

4. Cancellation and Refunds
vpsOne reserves the right to terminate a Client's account without notification if the account violates the Terms of Service. No refund will be given. Within the first 30 days of account creation, you are covered by a money-back guarantee. If you cancel the account within the first 30 days, a full refund will be made. After the first 30 days, you may cancel their account at any time, however, no refund will be given.

5. Bandwidth Usage Policy
vpsOne allows a large amount of bandwidth for your VPS. However, your service may be affected if the account exceeds the bandwidth limit. Please monitor your limit closely and contact our sales staff for purchasing more bandwidth if necessary.

6. Backups
It is the Client's responsibility to backup all files. No guarantees are made of any kind to the quality of any backups that may be made.

7. Technical Support
You should be familiar with web hosting services beforehand, and have a fair amount of knowledge of the operation of their sites. Our support staff are not able to teach you completely how to operate your VPS account.

We reserve the right to change the Terms of Service at any time without any notice. BY UPLOADING, SIGNING UP FOR ANY OF OUR PLANS, OR SUBMITTING ANY CONTENT TO VPSONE YOU SIGNIFY YOUR AGREEMENT TO THESE TERMS.
